The decision was announced by NH Attorney General John Formella on November 3, 2023, following the issuance of an order granting the State’s motion to dismiss by the Hillsborough South Superior Court.
SB 418 requires voters registering for the first time in New Hampshire on Election Day without sufficient proof of identity to vote by “affidavit ballot.”
These “affidavit ballots” are separated from other ballots and these voters have 7 days to mail in the appropriate documentation in order for their ballots to be counted. If these voters fail to do so, their votes will be discarded from the official election results.
